The Association of Trial Lawyers of America has objected to proposed limits for lawsuits against drug manufacturers. This is an obstacle to legislation that would pour billions of dollars into the production of vaccines against avian flu and other diseases.
Violating Consumers' Rights
Currently, they claim, that anti-lawsuit language in the bill so broadly protects pharmaceutical companies against lawsuits that consumers' rights would be violated. Republican lawmakers argue that the companies need to be protected against suits to give them an incentive to make the vaccines, which tend to be low-profit products.
No Compensation Program
Congressional Democrats have countered that people might refuse to take a vaccine which has no compensation program for people who get injured by it. Currently, they argue, no such program exists.
"Must Pass" Legislation
Republican leaders are considering attaching the anti-lawsuit provisions to an unrelated piece of "must pass" legislation in order to guarantee their passage. They might, for example, attach it as a rider to the bills that fund the Department of Health and Human Services or the Department of Defense.
